数字技术的日益发展和网络技术的日益普及深刻地改 变了整个人类的社会生活,以因特网为标志的“数字化生 存”时代即将来临。数字技术为作品创作和作品传播带来 了全方位的冲击,使著作权法遭遇到了前所未有的重大挑 战.直面网络时代,传统的著作权保护体系面临革新、重 组和部分制度的重新设计,著作权的理论也必须随之发展 和不断创新。笔者认为,现阶段理论界存有的二种不同观 点均值得商權。一是数字技术已经动摇了著作权法的基础,著作权的理论和保护体系均须重新设立。二是现有的理论 和体系并没有因网络的出现而受到动摇,版权界多年以来 积累的理论、制度、体系只须稍作修正便可适应数字化时 代的需要。
