华中科技大学博士学位论文 能,实现农地制度的创新发展.针对我国土地权利制度理论的局限性、制度供给安排的缺陷及滞后性、社会主 义农地公有制及公有产权实现形式的理论与实践难题,本文从产权与法权范畴的结 合上,建立起“农民土地持有产权制度”结构体系的新型土地产权理论模型。所谓“农民土地持有产权”,是指农民在一定期限内对集体所有土地权依法承受、持有利 用、收益分配、有限处分流转的结构性权利关系。它包括依法承受、持有利用权能,收益分配权能,流转权能和内部自治权能。它是在农民集体土地所有权终极保留的 基础上,对集体土地在一定年期内动态利用的实现形式,同农民集体土地所有权处 在一个对应关系的层面。
